35 U.S.C. §156 Hatch-Waxman calculator — restoring patent term lost to FDA review, capped at 5 years and 14-year effective life, benchmarked against EU SPC
Patent Term Extension under 35 U.S.C. §156, enacted as part of the Drug Price Competition and Patent Term Restoration Act of 1984 (the "Hatch-Waxman Act"), restores patent term that a drug sponsor loses while a product sits in FDA regulatory review rather than on the market. The entire calculation is a function of five dates pulled directly from the prosecution history and the regulatory approval file.
Every §156 calculation begins with a small, fixed set of dates, each independently verifiable from public records (USPTO Patent Application Information Retrieval and FDA Orange Book / Purple Book approval letters):
• Original filing date — the earliest effective U.S. filing date of the patent (priority date), which starts the 20-year term clock under 35 U.S.C. §154. • Patent grant/issue date — the date the patent issued; PTE does not extend patents that have already expired, and the patent must still be in force at the time of FDA approval. • IND effective date — the date the Investigational New Drug application became effective, marking the start of human clinical testing and the beginning of the "testing phase" for PTE purposes. • NDA/BLA submission date — the date the New Drug Application (small molecules) or Biologics License Application (biologics) was formally submitted to FDA, closing the testing phase and opening the "approval phase." • FDA approval date — the date FDA issued final marketing approval, which both ends the approval phase and starts the 60-day PTE filing clock and the 14-year effective-life clock.

PTE is available for exactly one patent per approved product — the applicant must choose which patent (drug substance, formulation, or method-of-use) to extend, typically the one covering the broadest commercially valuable claims, since the other unextended patents on the same product simply expire on schedule.
A patent claiming a new drug is typically filed early — often at first synthesis or proof-of-concept in animal models — long before the FDA approves it for sale. Between filing and approval, the invention sits through IND-enabling toxicology studies, three phases of human clinical trials, and FDA's substantive review, none of which the patent holder can sell against.
For small-molecule NMEs, median clinical development plus FDA review time has historically run 8–12 years; the 20-year statutory term (measured from filing, not from approval) means a sponsor can lose more than half of its nominal patent life before the product ever generates revenue. Congress's 1984 bargain in Hatch-Waxman was explicit: restore some of that lost term to branded drugs (via §156 PTE) in exchange for a streamlined generic approval pathway (the Abbreviated New Drug Application, ANDA) that lets generics rely on the innovator's safety and efficacy data once patents and any extension expire.
§156 extension is available for four categories of FDA-regulated products, each with its own definition of "regulatory review period":
• Human drug products (NDA/BLA) — small molecules and biologics • Medical devices (premarket approval, PMA) • Food or color additives requiring FDA approval • Veterinary biologics and animal drugs
The patent must claim the approved product itself, a method of using it, or a method of manufacturing it, and it must not have already been extended under §156 for a different product (a patent can receive PTE only once, even if it covers multiple approved products — the sponsor picks one). The patent must also still be unexpired on the date FDA grants approval; a patent that expires before approval cannot be revived by PTE.
Once the five dates are in hand, §156(c) reduces to straightforward date arithmetic split across two distinct phases of FDA review, each weighted differently to reflect how much of that period the sponsor could plausibly have used productively.
35 U.S.C. §156(c) defines the regulatory review period as the sum of two components:
PTE (raw, uncapped) = 0.5 × (testing phase) + 1.0 × (approval phase)
where:
testing phase = NDA/BLA submission date − IND effective date approval phase = FDA approval date − NDA/BLA submission date
The testing phase is halved because Congress judged that a diligent applicant could, in principle, have continued some commercial preparation activities during clinical trials — the phase is not treated as a total loss. The approval phase, by contrast, is credited in full: once the dossier is submitted, the applicant has done everything it can and is entirely at FDA's pace.
Worked example:
testing phase = Jan 10, 2016 − Jun 1, 2009 = 2,415 days → × 0.5 = 1,207.5 days approval phase = Nov 5, 2018 − Jan 10, 2016 = 1,030 days → × 1.0 = 1,030 days
raw PTE = 1,207.5 + 1,030 = 2,237.5 days ≈ 6.13 years
Only time during which the applicant acted with due diligence counts. FDA's Center for Drug Evaluation and Research (or the Patent and Trademark Office, which makes the final determination) can subtract periods of unexplained delay — e.g., a sponsor that stops responding to FDA information requests for months loses those months from the testing-phase credit, even though the clock nominally kept running.
Not every day inside the nominal date range counts toward PTE. Both USPTO and FDA scrutinize the record for excludable time:
Testing phase exclusions: • Periods before the IND became effective (pre-IND research does not count at all) • Time attributable to the applicant's own delay — e.g., failing to respond to an FDA clinical hold within a reasonable period • Time during a clinical hold caused by safety findings the sponsor did not diligently resolve
Approval phase exclusions: • Time consumed by a Refuse-to-File decision followed by resubmission (only the period after acceptance counts toward the credited window, though the excluded days are subtracted, not reset) • Major amendments requested by the applicant that trigger new review clocks • Periods where FDA formally notifies the applicant that its response to a deficiency letter was inadequate and further sponsor-caused delay results
In practice, PTO/FDA regulatory review period determinations are published in the Federal Register for public comment before becoming final, and third parties (typically generic manufacturers) frequently comment or litigate disputed exclusions, since every day of PTE granted is a day of exclusivity a generic competitor must wait out.
The two sliders in the control panel let you vary the testing-phase length (IND effective date to NDA/BLA submission, in days) and the approval-phase length (NDA/BLA submission to FDA approval, in days) independently. The live metrics recompute in real time using the exact §156(c) formula:

Notice that stretching the testing phase (more clinical-trial years) only adds half as much extension as stretching the approval phase by the same number of days — which is precisely why sponsors and their patent counsel pay close attention to FDA review-clock delays (approval phase) as the highest-leverage driver of PTE, even though testing phase is usually the much longer calendar period in absolute terms.
Even a very long regulatory review period does not translate one-for-one into patent life. §156(c) and §156(g) impose two independent ceilings, and whichever one is more restrictive in a given case controls the final extended expiration date.
No matter how large the raw regulatory review period computed in Stage 2, §156(g)(6)(A) caps the total extension granted to any single patent at 5 years. This cap exists regardless of product type (drug, biologic, device, food/color additive) and applies even when the sponsor endured an unusually protracted, fully diligent review.
In the worked example, raw PTE = 6.13 years, which exceeds the 5-year ceiling. The statutory cap therefore controls:
capped PTE = min(raw PTE, 5.00 years) = 5.00 years
Applied to the original expiration date (March 15, 2025), a flat 5-year addition yields an extended expiration date of March 15, 2030 — 1.13 years less than the uncapped calculation would have produced.
A second, independent ceiling limits total effective patent life — the period during which the patent owner can actually exclude competitors from a marketed product — to no more than 14 years measured from the FDA approval date, not from filing. This prevents a patent that issued unusually early (long before approval) from combining a large nominal extension with an already generous head start, producing an outsized commercial monopoly.

In the worked example: FDA approval was November 5, 2018. Fourteen years later is November 5, 2032. The 5-year-capped extended expiration date of March 15, 2030 falls well before that ceiling, so the 14-year cap is not binding here — the 5-year absolute cap is the operative constraint in this case.
Both caps are always evaluated, and the extended term is whichever produces the earlier expiration date:
extended expiration = min( original expiration + min(raw PTE, 5 yrs), FDA approval date + 14 yrs )
The 14-year cap becomes binding precisely when a patent issues very early relative to approval — e.g., a broad genus patent filed a decade before a specific compound within it reaches NDA submission. In such cases the 5-year nominal extension can be trimmed sharply, sometimes to a matter of months, because the approval-to-expiration window would otherwise blow past 14 years.
PTE under §156 is distinct from, and stacks on top of, Patent Term Adjustment (PTA) under 35 U.S.C. §154(b), which compensates for USPTO prosecution delay (e.g., slow office actions) rather than FDA regulatory delay. A patent's "original expiration date" for PTE purposes already reflects any PTA it accumulated during prosecution — PTE is then added on top of that PTA-adjusted date. The two mechanisms address different sources of term erosion (agency prosecution delay vs. agency regulatory-review delay) and Congress intentionally kept them additive rather than mutually exclusive, though a single patent cannot receive PTE more than once.
Before any cap or formula matters, a PTE application must clear three procedural gates: the applicant must have pursued approval with due diligence, only one patent per approved product may be extended, and the application itself must be filed with the USPTO within a strict 60-day window after FDA approval.
§156(d)(1) requires the patent owner (or its agent) to file the PTE application with the USPTO Director within 60 days of the date the product receives FDA approval. This is a hard statutory deadline with essentially no equitable exceptions — missing it forfeits the extension entirely, even if the underlying regulatory review period was substantial.
Because the deadline is so unforgiving, sophisticated sponsors begin drafting the PTE application (which must include a copy of the patent, the regulatory review period calculation, and documentation of the relevant dates) well before the anticipated approval date, so it can be filed within days of the approval letter.
If the patent is still in force but due to expire before FDA completes its review, §156(d)(5) allows the applicant to request an "interim extension" of up to one year at a time (renewable) to bridge the gap until final approval, preserving eligibility for the full PTE calculation once approval is granted.
A sponsor typically holds several patents covering different aspects of an approved drug: the active ingredient (composition of matter), a specific formulation, a method of treatment, or a crystalline form. §156 permits extension of only one such patent per approved product, and the choice is generally treated as irrevocable once made.
Selecting the right patent is a significant strategic decision for patent counsel:
• Composition-of-matter patents (covering the molecule itself) are usually the strongest choice — they block essentially all generic competition, including alternative formulations or delivery routes, for the extended term. • Method-of-use patents extend protection only for the specific approved use, leaving room for generics to enter under a "skinny label" carve-out for unapproved uses (a frequent source of Hatch-Waxman litigation). • Formulation patents protect only that specific dosage form, allowing generics to potentially design around with a different formulation of the same active ingredient.
Because only one patent gets the extension, sponsors nearly always extend the broadest, most commercially blocking patent — typically the composition-of-matter claim — while allowing narrower patents on the same product to expire on their unextended schedule.
A notable strategic wrinkle: if a company holds multiple patents on a product and mistakenly (or deliberately) extends a narrower one, competitors can sometimes design around the extended patent while the broader, unextended composition-of-matter patent has already expired — effectively opening the market years earlier than optimal. Patent term extension election is a one-shot, high-stakes decision reviewed carefully by outside patent counsel.
While the testing-phase formula automatically halves the credited days, the applicant must additionally demonstrate that it acted with due diligence throughout the entire regulatory review period — not merely that time passed. The USPTO, in consultation with FDA, reviews the sponsor's own submitted diligence statement, which documents:
• Continuous, active pursuit of the clinical development plan (no unexplained multi-month gaps in trial activity) • Prompt responses to FDA information requests, clinical holds, and deficiency letters • Timely resubmission after any Refuse-to-File or Complete Response Letter
Periods found to reflect sponsor inattention — rather than genuine scientific, manufacturing, or regulatory necessity — are excluded from the regulatory review period before the 0.5× / 1.0× formula is even applied, shrinking the raw PTE calculated in Stage 2 before the caps in Stage 3 are ever reached. Diligence review is therefore a threshold, date-by-date factual inquiry, not just a formality.
The final output of the §156 process is a single new expiration date for the elected patent — recorded by the USPTO and reflected in the FDA Orange Book. Sponsors filing globally must run a parallel, differently-structured calculation for Europe: the Supplementary Protection Certificate (SPC) regime, which can extend effective protection further still via a pediatric bonus.
Putting the worked example together end-to-end:

This is the date recorded on the face of the patent by USPTO certificate of extension, and the date generic ANDA applicants must track (alongside the FDA Orange Book listing) to know when 30-month-stay litigation windows and exclusivity periods finally close for this particular patent.
The European Union addresses the identical problem — patent life eroded by regulatory review — through Supplementary Protection Certificates, created by EU Regulation 469/2009 (medicinal products) and 1610/96 (plant protection products). The mechanics differ meaningfully from §156:
SPC term = (date of first EU marketing authorization − patent filing date) − 5 years, capped at 5 years
Unlike the U.S. formula, the EU calculation does not split review into weighted "testing" and "approval" phases at all — it simply looks at the total gap between filing and first marketing authorization, subtracts a flat 5 years (representing the minimum period Europe judges a sponsor should expect to wait), and caps the result at 5 years.
Applied to the same illustrative dates (filing March 15, 2005; assume EU authorization also November 5, 2018):
gap = Nov 5, 2018 − Mar 15, 2005 = 13.64 years SPC term = 13.64 − 5 = 8.64 years → capped at 5.00 years
SPC term runs from patent expiry, so: March 15, 2025 + 5.00 years = March 15, 2030 — coincidentally identical to the U.S. result in this example, though the two formulas will diverge whenever the testing/approval split is uneven.
Under the EU Paediatric Regulation (EC 1901/2006), an SPC holder who completes an agreed Paediatric Investigation Plan (PIP) — clinical studies of the medicine in children, even if the product is never marketed for pediatric use — earns an automatic 6-month extension of the SPC term, applied on top of the up-to-5-year SPC calculated above.
With the pediatric extension: March 15, 2030 + 6 months = September 15, 2030 — six months longer than the comparable U.S. position in this example.
The U.S. has a related but structurally different incentive: pediatric exclusivity under the Best Pharmaceuticals for Children Act (BPCA), which also grants 6 months, but as regulatory marketing exclusivity layered onto all of a sponsor's patents and exclusivities covering the product (delaying ANDA approval), rather than as an extension of a single patent's term the way the EU pediatric SPC extension is. The practical commercial effect — roughly half a year of additional protection for pediatric study data — is similar, but the legal mechanism (patent-term extension in the EU vs. regulatory exclusivity layered on top of patents in the U.S.) is different enough that global patent strategy teams model them separately.
A single innovator drug approved in both the U.S. and EU around the same time can therefore end up with two different "true" expiration dates for what is nominally "the same patent family" — because the U.S. §156 halves testing-phase time while the EU SPC formula does not split phases at all, and because the two pediatric bonus mechanisms attach to different legal instruments. Global IP teams maintain jurisdiction-by-jurisdiction expiration trackers precisely because these dates are never guaranteed to align.
