The Best Pharmaceuticals for Children Act (BPCA), first enacted in 2002 and made permanent by FDASIA in 2012, gives FDA a unique regulatory tool: it can ask — not order — a sponsor of an already-approved drug to study that drug in children. If the sponsor agrees and completes the requested studies, FDA rewards the entire product, not just a new claim, with six extra months of market exclusivity. The mechanism begins with a document called the Written Request.
A Written Request (WR) is issued by FDA's Office of Pediatric Therapeutics after internal review (often informed by the Pediatric Review Committee, PeRC) of whether pediatric data on a given drug would be of public health value. The WR is a highly specific technical document, not a general instruction to "study children." It typically specifies:
• Which pediatric age cohorts must be studied — neonates (0–27 days), infants (28 days–23 months), children (2–11 years), adolescents (12–16/18 years) — FDA increasingly requires the full age spectrum relevant to the disease • The clinical questions: dosing/exposure-matching via population PK, safety in the pediatric population, and — where ethically feasible — efficacy (often via extrapolation from adult efficacy plus PK bridging, rather than a full pediatric efficacy trial) • Study design parameters: sample size, comparator, endpoints, statistical analysis plan • A deadline: date by which the sponsor must submit pediatric study reports
The WR can be issued for on-patent, off-patent, and even generically-available molecules if FDA determines pediatric information is still lacking and medically important. This distinguishes BPCA from ordinary NDA review: it can reopen exclusivity conversations on drugs approved decades earlier.
A sponsor is never compelled to accept a Written Request. Declining forfeits the voluntary 6-month exclusivity opportunity but carries no penalty — this is what separates BPCA (carrot) from PREA (stick, see Stage 2). Sponsors of blockbuster drugs facing patent-cliff pressure have strong financial incentive to accept.
Historically, most drugs were approved and labeled almost entirely on adult data, leaving pediatricians to prescribe "off-label" using extrapolated, often incorrect, doses. Children are not simply small adults: hepatic and renal clearance, body-water distribution, receptor expression, and even drug-metabolizing enzyme ontogeny (e.g., CYP3A4 activity rises sharply in the first year of life) change nonlinearly with age. Historic mismatches — chloramphenicol "gray baby syndrome," inappropriate propofol infusions in pediatric ICU (PRIS), and mis-dosed antiepileptics — motivated Congress to create financial incentives strong enough to make routine pediatric study commercially rational.
BPCA's theory of the case: a straightforward statutory exclusivity extension, applied automatically to whatever exclusivity or patent life the product already has, is simple enough for finance teams to model and valuable enough (worth hundreds of millions on a blockbuster, see Stage 4) to reliably move sponsor behavior — far more reliably than a mandate alone.
Every sponsor navigating pediatric obligations must track two separate, complementary statutes simultaneously: the Pediatric Research Equity Act (PREA, 2003) which mandates pediatric assessment for most new drug and biologic applications, and BPCA which offers exclusivity as an incentive for going beyond that mandate. Confusing the two is a common and costly sponsor mistake.
PREA requires that most NDAs, BLAs, and supplements for a new active ingredient, indication, dosage form, dosing regimen, or route of administration include an assessment of safety and effectiveness in relevant pediatric subpopulations, using the Pediatric Study Plan (PSP) submitted early in development (typically by the End-of-Phase 2 meeting).
Key PREA mechanics: • Deferrals: FDA can defer pediatric studies until after adult approval (common when the disease predominantly affects adults, or pediatric dosing science is not yet mature) • Waivers: full or partial waiver if the disease does not occur in children, if studies are impossible/highly impractical, or if the drug is unsafe/ineffective in children • Orphan drug carve-out: PREA does NOT apply to drugs with orphan drug designation for the studied indication — historically a major carve-out, though FDARA 2017 required molecularly-targeted oncology drugs to comply with PREA regardless of orphan status • Enforcement: PREA is a mandate — failure to comply can result in a "Non-Compliance" letter, and ultimately the drug can be deemed misbranded
BPCA studies are requested via the Written Request and are legally voluntary — but the exclusivity payoff is only available through this track, not through PREA compliance. In practice, sophisticated sponsors interact with the two systems as follows:
1. PREA-mandated studies satisfy the legal requirement to assess pediatric use — but completing only the PREA minimum earns zero exclusivity 2. Sponsors can request that FDA convert or expand a PREA obligation into (or alongside) a BPCA Written Request, effectively "upgrading" mandatory work into exclusivity-eligible work — since overlapping study designs can sometimes satisfy both 3. A sponsor may also receive a WR for indications or age groups PREA does not reach (e.g., an orphan-carved-out oncology drug, or off-patent generic-heavy products where no PREA obligation exists at all) — pure BPCA-only value
The design decision each sponsor faces: negotiate WR study protocols (age cohorts, endpoints, statistical power) that are scientifically defensible, ethically approvable by pediatric IRBs, and completable within the WR deadline — typically 2-4 years from issuance for the full pediatric development program.
Worked example: a company developing a new hypertension drug must, under PREA, study efficacy in adolescents with primary hypertension (a pediatric-relevant condition) as a condition of approval — mandatory, no exclusivity. If FDA additionally issues a Written Request asking the company to also study neonatal and infant dosing via PK-only bridging studies (a population PREA did not mandate), completing that additional voluntary work earns the 6-month BPCA exclusivity.
The most counter-intuitive and commercially important feature of BPCA is this: exclusivity is earned by completing the studies specified in the Written Request in good faith and submitting them on time — not by proving the drug works or is safe in children. A negative, inconclusive, or even safety-concerning pediatric result still earns the 6-month exclusivity, provided the sponsor met the WR's terms.
Once pediatric study reports (PSRs) are submitted, FDA's determination is narrow and procedural: did the sponsor conduct the studies described in the Written Request, in the manner and timeframe specified, in good faith? FDA is not re-litigating whether the drug is a good pediatric therapy at this stage — that clinical judgment is reflected separately in labeling.
This design is deliberate. Congress recognized that if exclusivity were conditioned on a positive outcome, sponsors would have every incentive to design underpowered studies, cherry-pick easy endpoints, or quietly abandon pediatric programs that looked likely to show harm or lack of benefit — precisely the opposite of what a program meant to generate pediatric safety data should incentivize. By decoupling the reward from the result, BPCA maximizes the incentive to actually generate pediatric evidence, including evidence of ineffectiveness or unexpected toxicity that protects children from off-label misuse.
Common real-world outcomes: • Drug found NOT effective in children (e.g., several antidepressants and pain medications) — exclusivity still granted; label often gains a statement that efficacy was not established in pediatric patients, which itself has clinical value by preventing off-label extrapolation • Drug found effective with a different dose than expected — exclusivity granted; label gains new pediatric dosing table • Unexpected pediatric safety signal identified — exclusivity still granted; label gains a boxed warning or contraindication for pediatric use
Historic example pattern: several SSRI antidepressants received Written Requests in the early 2000s; pediatric trials revealed increased suicidality risk signals in adolescents. The sponsors still received 6-month exclusivity for completing the requested studies in good faith — while FDA separately used the same data to mandate a boxed warning, illustrating that the exclusivity and the safety-label consequences are decoupled processes.
After PSR submission, FDA's Office of Pediatric Therapeutics coordinates a compliance review (typically within ~90 days) confirming the study package satisfies the WR terms. If satisfied, FDA issues a formal letter to the sponsor confirming that 6-month exclusivity under §505A will be added to the product's Orange Book listing. If the studies are judged non-compliant (e.g., materially different design without FDA agreement, missed enrollment thresholds making results uninterpretable, or missed deadlines without an approved extension), exclusivity can be denied — a high-stakes commercial outcome that puts significant pressure on trial operations teams to execute WR protocols exactly as negotiated.
The single most valuable — and most misunderstood — mechanic in BPCA is scope. The 6-month exclusivity is not a new, narrow protection layered on top of a single patent claim. It is a blanket 180-day extension applied simultaneously to every unexpired patent listed in the Orange Book for that product AND every other regulatory exclusivity (NCE, orphan drug, new-indication) still in force — multiplying the commercial value far beyond the cost of the underlying trials.
Under Hatch-Waxman, generic (ANDA) or 505(b)(2) competitors normally cannot enter the market until the last relevant Orange Book-listed patent expires or is successfully challenged, and until any regulatory exclusivity period (e.g., 5-year New Chemical Entity exclusivity, 3-year new-indication exclusivity, 7-year orphan drug exclusivity) lapses. BPCA pediatric exclusivity does not create a new independent right — it mathematically adds 180 days onto whichever of those protections would otherwise expire LAST.
This means: • If a product has a composition-of-matter patent expiring in 2027 and an orphan exclusivity expiring in 2026, the 180-day pediatric extension pushes the 2027 patent date to 2027 + 180 days — generics blocked an additional six months from the true last-to-expire date • If the product has multiple patents with staggered expirations, EVERY one of them individually receives the 180-day push, preserving the sponsor's full patent estate structure (including secondary/formulation patents) for six additional months, not just the primary patent • The extension applies regardless of how many WR studies were required (2 studies or 6), regardless of how much they cost, and regardless of whether results were positive — a flat 180 days is the statutory reward
The standard back-of-envelope valuation sponsors use: take the product's current annual revenue run-rate (which approximates what would be lost to generic erosion the day protection expires) and multiply by 0.5, representing six months of exclusivity-protected sales that would otherwise have been lost to lower-priced generic competition.
Worked example: • Product with $3 billion/year revenue run-rate at time of patent-cliff approach • 6-month exclusivity extension → 6/12 × $3,000M ≈ $1,500M of preserved branded revenue • Cost of the two pediatric studies requested in the Written Request: ~$4M • Return on the pediatric study investment: ~375x
Even heavily discounting for the fact that generic entry rarely captures 100% of volume immediately (typical first-90-day generic substitution is 70–90% of volume at 80-85% price discount, meaning the true "value at risk" during those 6 months is usually 40-70% of gross run-rate, not 100%), the realistic value is still commonly in the hundreds of millions for a blockbuster — dwarfing single-digit-million trial costs by orders of magnitude.
Use the sliders in this simulator: at $3,000M/year revenue, the naive 6-month extension value is ≈$1,500M against a typical $1-5M pediatric study cost. Drop the revenue slider to a $300M niche product and the same 6 months is worth ≈$150M — still a 30-150x return, illustrating why BPCA participation is financially rational across nearly the entire size range of marketed drugs, not just mega-blockbusters.
Once exclusivity is granted, sponsors and portfolio strategists evaluate realized value against the alternative pathway: the Rare Pediatric Disease Priority Review Voucher (RPD-PRV) program, a structurally different, transferable and sellable reward created by FDASIA (2012) for approvals treating rare pediatric diseases — regardless of whether a Written Request was ever issued.
The RPD-PRV is a completely distinct instrument from the 6-month BPCA exclusivity described above, and the two are frequently confused:
• BPCA 6-month exclusivity: earned by completing FDA-requested pediatric studies on an ALREADY-MARKETED drug; extends existing patents/exclusivities on THAT SAME product; cannot be sold or transferred; automatically applied to the product's own Orange Book listing
• Rare Pediatric Disease Priority Review Voucher: earned upon FDA APPROVAL of a drug or biologic for a "rare pediatric disease" (defined as a serious/life-threatening disease affecting <200,000 people in the US, manifesting in ages 0-18); the voucher entitles the HOLDER to a priority review (~6-month standard review compressed to a shorter clock) for ANY future NDA/BLA submission — the holder's own next product, or a voucher purchased from someone else
Critically, the RPD-PRV is transferable — it can be sold on the open market to any other sponsor, who can redeem it on an unrelated product. This transferability is what created a real dollar market price for something that is, at its core, four months of accelerated regulatory review.
Because vouchers are fungible and transferable, publicly disclosed sale prices provide real market benchmarks:
• United Therapeutics sold a voucher for $350 million (2015) — the highest publicly disclosed sale at the time, to AbbVie • BioMarin sold a voucher for $125 million (2014) to Gilead Sciences • Sarepta Therapeutics sold a voucher for approximately $102 million (2017) • Other disclosed transactions have ranged as low as ~$80 million in later years as voucher supply increased and buyer scarcity eased
Why a buyer would pay $80-350M for ~4 months of faster review: for a blockbuster-track drug awaiting approval, moving the launch date earlier by even a few months can be worth many multiples of the voucher price in incremental exclusive-period sales, plus first-mover advantage against a competing therapy. The voucher is essentially a purchasable option on speed-to-market.
Portfolio ROI comparison for a sponsor deciding where to invest limited pediatric-development dollars:
• Blockbuster on-market product + BPCA Written Request: $1-5M study cost → typically $100M-$1.5B+ in preserved exclusive revenue (see Stage 4 math) — enormous ROI but only available to products already generating meaningful revenue • Niche/rare disease pipeline asset + qualifying for RPD-PRV: pediatric trial costs already embedded in normal registration-enabling trials (not incremental) → $80-350M in voucher sale proceeds, monetizable immediately at approval, useful even for companies with no other marketed revenue
Sponsors with a broad pediatric-eligible portfolio increasingly run both plays simultaneously — pursuing BPCA exclusivity on mature blockbusters nearing patent cliffs while also structuring early-stage rare disease programs to qualify for RPD-PRV designation, since the two income streams draw on almost entirely non-overlapping population and regulatory criteria.
Portfolio takeaway: a company with a $3B/year drug approaching patent expiration and a separate early-stage rare pediatric cancer asset in Phase 2 can, in principle, realize both ≈$1.5B in preserved revenue from a BPCA Written Request on the blockbuster AND $100-300M in cash from selling an RPD-PRV earned by the rare-disease approval — two structurally independent, stackable value streams from the same underlying pediatric-development strategy.
